An employer’s duty to provide workers’ compensation benefits (WCB) depends on several factors including the number and type of injuries sustained by employees, the level of wages paid to employees, length of employment, and if they are self-employed.

According to the Office of Workers’ Compensation Programs, employers must provide WCB benefits only if they pay their employees more than minimum wage for hourly directly compensated workers only; minimum wage paid by hourly compensated workers will not qualify them for WCB benefits.

For employers to receive WCB benefits companies must meet certain requirements including that: no employee suffers more than three types of work-related injuries during any 12 months; no employee is self-employed, and no employee receives less than $275 per week in wages (not adjusted for overtime).

The Office of Workers’ Compensation Programs notes that seven types of injuries require WCB coverage: back injuries; spinal cord and nerve damage from repetitive motion; broken bones and/or skull fractures; burns; fractures resulting in limb disuse (e.g., deafness due to loss of hearing); musculoskeletal disorders (e.g., arthritis); work-related cancers (e.g., leukemia); and skin cancer due to exposure to asbestos dust or radiation exposure
