In the last few months, there have been several claims regarding commercial trucks in California. These claims have resulted in a series of laws and regulations being passed by state lawmakers and added to to the National Motor Vehicle Title System (NMVT) database.
The recent passage of AB 1320, also known as the California Commercial Truck Insurance Act, was introduced on April 23rd at the request of California Trucking Association Executive Director Ray Ramos.
In an interview with KGO-TV that aired on May 22nd, Ramos explained why it was important for California to enact commercial truck insurance laws.
“I think we need to help our trucking community because they’re really up against it, they’re trying to compete against each other and they need help, we need to make sure that everybody is covered,” said Ramos. “We would like it if every one of these companies were going out there selling their product but unfortunately some companies are not taking advantage of what we offer.”
The bill passed through Assembly when lawmakers returned from their May recess. It now heads to the State Senate for consideration.
The proposed legislation would require insurers operating in the state to purchase coverage from a national provider approved by the National Highway Traffic Safety Administration (NHTSA). The bill would require insurers operating in the state to maintain liability limits under $50 million and aggregate limits over $50 million for all commercial carriers licensed or authorized by the state.
Those with private drivers’ licenses would be required by law to carry driver’s license coverage from an approved provider. The same requirement would apply for commercial manufacturers and importers licensed by DMV who are also licensed or authorized by DMV. The bill would prohibit such providers from offering additional professional driver’s insurance coverage unless those policies were specifically approved by NHTSA or a certifying agency recognized by NHTSA as an acceptable source of professional driver’s insurance under the authority granted in 49 U.S.C., § 17545(b)(1)(E).
Several states have already enacted similar legislation requiring insurers operating in those states be required to purchase commercial truck insurance from an approved provider, according to NMVT Database administrators at State Farm Insurance Company (SFIC). In addition, several states have enacted similar legislation requiring insurers operating in those states to be required all offer commercial truck coverage.
